Over the past year, concerns have mounted regarding the reliability of AI-generated content, particularly as lawyers, judges, and bad actors alike have access to advanced image and voice manipulation technologies. The prevalence of these tools has implications for the integrity and perceived trustworthiness of the justice system. Public trust in legal outcomes has become more fragile as digital evidence can be questioned, manipulated, or fabricated more easily than before.

When similar concerns arose in earlier reports, discussions mainly focused on the potential for AI to streamline legal work and reduce costs. Recent coverage, however, adds a sense of urgency around the misuse of deepfake evidence and the challenges of verifying authenticity. Previously, the benefits of automation and efficiency in research were highlighted, but the latest findings document a heightened awareness of national security risks, misinformation, and increased stress among practitioners. These developments reveal a more complex balance of innovation and vulnerability within the legal field than what was initially predicted.

According to the ABA report, many lawyers use AI to automate repetitive and time-consuming tasks. “Many highlighted generative AI—large language models in particular—as a game-changer for accelerating routine tasks like contract analysis and litigation preparation, as well as helping firms produce first drafts, summarize large datasets, and customize communications at scale.”

What Risks Do Deepfakes and AI Present to Courts?

As AI-generated materials, including deepfake images, audio, and video, become more sophisticated, risks to the court system grow alongside them. Fake evidence can mimic witnesses, judges, or litigants with alarming realism, complicating authentication and endangering the fact-finding process that trials rely on. The ABA emphasized,

“Faced with deepfakes offered as evidence in court or claims that legitimate evidence is a deepfake, judges are grappling with questions surrounding the authenticity, validity, and reliability of AI-generated evidence.”

Agencies such as the FBI and Cybersecurity and Infrastructure Security Agency have warned of the long-term national security threats posed by these technologies. The easy distribution of manipulated content increases the spread of disinformation, prompting the need for new protocols and scrutiny within the legal system.

Can Guidelines Address AI-Related Challenges in Legal Settings?

Efforts to address risks include the ABA’s AI task force, which comprises judges and experts aiming to create guidance on responsible AI use in legal proceedings. The group will tackle procedures concerning the introduction of AI-generated evidence and strategies for recognizing and countering deepfakes. Broader legal and ethical questions also arise around risk management, liability, and the credibility of digital records in trial contexts. Efforts extend to increasing awareness among legal practitioners and updating court procedures as more evidence becomes subject to claims of AI involvement.

Broader challenges noted in the report echo concerns about increasing workloads and systemic stress in the legal profession, as documented by the Association of Corporate Counsel. Supreme Court Chief Justice John Roberts also noted threats to judicial integrity posed by malicious actors harnessing AI for misinformation or cyberattacks. As courts rely more on digital processes, they face growing obstacles verifying truth and upholding transparency, especially as digital narratives can be shaped by automated systems and savvy media manipulation.

AI introduces complex opportunities and vulnerabilities to the legal profession, requiring vigilance, updated protocols, and transparency from all court participants.
