California’s State Assembly has given the green light to the Safe and Secure Innovation for Frontier Artificial Intelligence Models Act (SB 1047). This legislation introduces several safety protocols for AI firms operating within the state. If the bill becomes law, it could reshape the regulatory landscape for AI development, potentially setting a national precedent.

Earlier discussions about AI safety regulations did not result in concrete policies like SB 1047. This bill marks a shift towards more stringent oversight, reflecting growing concerns about the risks associated with advanced AI systems. Compared to previous efforts, the current bill places a stronger emphasis on preventing catastrophic harm and includes specific enforcement mechanisms, such as civil penalties and model shutdown protocols. The push for this bill signifies a heightened awareness of AI’s potential dangers, contrasting with earlier, less comprehensive approaches.

Regulatory Measures Introduced

The bill mandates several safety measures for AI models, including mechanisms to enable rapid and complete shutdown of models if necessary. Additionally, it requires the establishment of testing procedures to evaluate potential risks that these models or their derivatives might pose. The legislation also aims to protect models against unsafe post-training modifications.

Support and Opposition

Senator Scott Wiener, the primary sponsor of SB 1047, highlighted the collaborative effort behind the bill.

“We’ve worked hard all year, with open source advocates, Anthropic, and others, to refine and improve the bill. SB 1047 is well calibrated to what we know about foreseeable AI risks, and it deserves to be enacted.”

Despite this, tech giants like OpenAI and Anthropic, as well as political figures and the California Chamber of Commerce, have raised concerns. They argue that the bill disproportionately targets small, open-source developers and focuses excessively on catastrophic risks.

In response to these criticisms, the bill has undergone several amendments. These include replacing potential criminal penalties with civil ones and limiting the enforcement powers of California’s attorney general. Additionally, the criteria for joining the ‘Board of Frontier Models,’ a regulatory body created by the bill, have been modified.

The Senate will vote on SB 1047 next, and if it passes, it will be sent to Governor Gavin Newsom. He will have until the end of September to decide on its enactment. The passage of this bill could set a regulatory example for other states, influencing the future of AI legislation across the country.

As one of the first significant AI regulations in the US, the outcome of SB 1047 may have broad implications for the AI sector. The bill’s stringent requirements could encourage other jurisdictions to adopt similar measures, potentially reshaping the development and implementation of advanced AI models on a national and even international scale. The ongoing debate highlights a critical junction in AI governance, balancing innovation with safety concerns.
