The Centre for Long-Term Resilience (CLTR) has emphasized the necessity for a structured incident reporting system to fill a significant void in the UK’s AI regulation plans. The proposal highlights the growing integration of AI into various societal sectors and the subsequent increase in frequency and severity of AI-related incidents, which have surpassed 10,000 since 2014. Importance of Incident Reporting

The CLTR underscores the vital role of an incident reporting regime in effective AI regulation, drawing inspiration from safety-critical sectors like aviation and healthcare. This perspective is supported by a wide range of experts, governmental bodies in the US and China, and the European Union. The report details three primary benefits of such a system: monitoring real-world AI safety risks to guide regulatory changes, coordinating rapid responses to major incidents while investigating their root causes, and identifying early warnings of potential large-scale future harms.

Current Gaps in UK Regulation

At present, the UK’s AI regulatory framework lacks an effective incident reporting mechanism, leaving the Department for Science, Innovation & Technology (DSIT) blind to several critical incidents. These include issues with highly capable foundation models, the UK Government’s own AI usage in public services, malicious misuse of AI systems, and harms caused by AI companions, tutors, and therapists. The absence of a proper reporting system may force DSIT to rely on news outlets for information on novel harms, lacking an established process for systematic reporting.

Recommendations for Improvement

To bridge this regulatory gap, the CLTR recommends three immediate actions for the UK Government. Firstly, establish a government incident reporting system to document AI-related incidents in public services, expanding the existing Algorithmic Transparency Recording Standard (ATRS). Secondly, engage regulators and consult with experts to identify the most critical gaps, ensuring comprehensive coverage and understanding stakeholder needs. Lastly, enhance DSIT’s capacity to monitor, investigate, and respond to incidents, potentially through a pilot AI incident database focusing initially on the most urgent gaps before expanding to include all reports from UK regulators.

In previous discussions about AI incident reporting, various experts have highlighted the challenges in balancing regulation with innovation. The insights gathered indicate a consensus on the necessity of such a system but also emphasize the importance of not stifling the AI industry’s potential. Comparatively, recent debates have also focused on the global alignment of AI regulations, suggesting that international cooperation might be a beneficial approach to creating a cohesive and effective incident reporting framework.

Additionally, there have been suggestions that AI incident reporting could be integrated into broader digital governance frameworks, which include other emerging technologies. This integration could streamline the process and make it more effective. However, contrasting views have also suggested that too broad an approach might dilute the focus needed to address AI-specific issues, underlining the need for a dedicated system.

As AI continues to advance, establishing a robust incident reporting system is crucial to mitigating risks and ensuring the safe development and deployment of AI technologies. Implementing these recommendations could significantly enhance the government’s ability to responsibly improve public services, effectively cover priority incidents, and develop essential infrastructure for AI incident response. Having a centralized incident reporting mechanism ensures that potential harms are documented and addressed swiftly, maintaining public trust and safety in AI systems.
